Express consent is not required for treatment in the event of an emergency when certain conditions are met.
Situations when consent for emergency treatment is not required:
(1) The person is unable to communicate (due to injury, accident, illness or unconsciousness) AND the person has what reasonably appears to be a life-threatening injury or illness.
(2) A court orders the treatment of an individual AND the person has an emergent condition that may cause serious bodily injury or loss of life.
(3) The person is a minor AND
(3a) the person has what reasonably appears to be a life-threatening illness AND
(3b) the parent(s), managing conservator, possessing conservator, or guardian is/are not present.
